1. Who this applies to

These Terms apply to anyone using SpatialProbe's apps (the 3D globe explorer, Photos) or website. Creating an account means you accept them. If you don't agree, please don't create an account or use the Service.

2. Your account

You need an account to use the Service -- there is no free/anonymous tier. You're responsible for keeping your password (and any device you're signed in on) secure, and for everything that happens under your account. One account per person -- no sharing logins.

Minimum age. You must be at least 18 years old to create an account or use SpatialProbe. The Service is intended strictly for adults. If you are under 18, you may not create an account or access the Service.

A username you pick is permanent once set (it can't be changed later) and stays public, including as the credit line on any content of yours the Service shows to others.

3. Content you upload -- the license, in plain terms

Whatever you upload, and whether you keep it public or private, you're granting SpatialProbe a license to store it, process it (resize, transcode, generate thumbnails), and display it back to you -- this is what lets the Service function at all, and applies regardless of anything below. You keep ownership either way: none of this transfers copyright to SpatialProbe.

Separately, for any photo or video you leave public (the default -- unchecking "Keep private" at upload keeps it visible only to you and anyone you share a direct link with), you choose what reuse rights other people get, from three options presented at upload:

  1. All rights reserved. Viewable by anyone browsing SpatialProbe, but no reuse rights are granted to anyone else -- no copying, redistribution, or reuse beyond viewing it on the Service. Full copyright stays exclusively yours in every sense.
  2. Creative Commons Attribution 4.0 International (CC BY 4.0). Anyone may copy, download, redistribute, remix, and use it commercially -- with no royalty owed to you -- as long as they credit you, link back to the license, and note if they changed it.
  3. Creative Commons Attribution-NonCommercial 4.0 International (CC BY-NC 4.0). Same as CC BY 4.0 above, but commercial use isn't permitted -- reuse is limited to non-commercial purposes.

Whichever you pick, they don't need your permission first for whatever the chosen license actually permits, and they don't owe you anything beyond what it requires (e.g. attribution under the two CC options).

You must actually have the right to upload it. Only upload photos/videos you took yourself (or otherwise genuinely own the rights to) -- you can't grant a license to something that isn't yours to license, under any of the three options. Uploading someone else's work without permission, passing it off as your own, or uploading content that infringes someone else's copyright is a Terms violation and may be removed, alongside legal exposure that's yours alone, not SpatialProbe's.

The two Creative Commons options are irrevocable once granted -- standard for CC, and necessary for it to mean anything: someone who already downloaded, printed, or built on your CC-licensed public photo before you deleted it or your account keeps the right to keep using that copy under the same terms. Deleting a photo, or your whole account, stops new people from getting it through SpatialProbe going forward (see Section 7) -- it doesn't reach back and un-license copies already out in the world.

"All rights reserved" doesn't have this problem, and that's the point of offering it. Because no reuse license is ever granted to anyone else under that option, deleting the photo or your account is a genuine, full removal -- nothing survives anywhere that SpatialProbe granted to a third party, because nothing was. If keeping a clean "delete means gone" guarantee on your public content matters more to you than maximum reach, this is the option that gives you that.

Attribution travels with the file itself. When a public photo or video is downloaded through the Service, your username and a link back to your profile are embedded directly in the file's own metadata alongside a note of whichever of the three licenses above it's actually shared under -- not just shown on the page around it. That's a practical measure to make the credit requirement easier to honor and to trace for the CC options, and a clear record either way, not a separate legal obligation beyond whichever license actually applies.

Content you keep private is never licensed to anyone under any of the three options -- it's shown only to you (and, if you attach it to a Journey you publish, to that Journey's viewers, under whichever license you chose for it, once it's reachable that way).

Journeys built from your photos/videos. If a photo or video attached to a published Journey is later removed -- because you deleted it yourself, a moderator took it down for a Terms violation, or (for "All rights reserved" content) your account was deleted -- the Journey is automatically reverted to draft and you're shown which item(s) went missing, rather than being left live with a silent gap. You can then replace the missing item, edit around it, or republish as-is once you've reviewed it.

4. What's not allowed

SpatialProbe has zero tolerance for the following. Don't upload, post, or use the Service to facilitate any content that:

  1. Is illegal where you or SpatialProbe operate;
  2. Is pornographic or sexually explicit in any way -- this is a strict, absolute rule with no exceptions for context, artistic intent, or claimed consent;
  3. Depicts or sexualizes minors, in any way whatsoever -- zero tolerance, immediate account termination, and reported to the relevant authorities and NCMEC without exception;
  4. Contains gore, graphic violence, mutilation, or real depictions of death or severe injury, or that glorifies, incites, or provides instructions for violence, self-harm, or suicide;
  5. Harasses, threatens, intimidates, stalks, or doxxes (publishes private, identifying information about) a real person, or is directed at inciting others to do so;
  6. Is hateful toward, or attacks the dignity of, a person or group based on race, religion, ethnicity, national origin, gender, sexual orientation, disability, or any similar protected characteristic;
  7. Promotes, supports, or provides material assistance to terrorism, violent extremism, or organized criminal activity;
  8. Infringes someone else's copyright, trademark, or privacy;
  9. Is spam, or exists mainly to advertise something unrelated;
  10. Contains malware or is designed to disrupt the Service for others.

Every upload and every profile bio/comment goes through automated screening before becoming visible to anyone but you, with human moderator review on anything flagged. Violating content is rejected or removed immediately on detection, without prior warning, and repeat or severe violations -- including any violation of items 2 through 7 above -- will get an account suspended or permanently deleted. Where content is illegal (in particular anything involving minors), it is reported to law enforcement and relevant authorities in addition to being removed.

Appeals. If you believe your content or account was flagged, rejected, or suspended in error, contact us (see Section 11) to request a human review.

5. Subscriptions & billing

An active plan is required to use SpatialProbe at all -- there's no free tier. Both plans include full access to Explore and Photos, uploading, and storage; the Explorer plan additionally keeps your original files (not just resized copies) and includes metadata tools and priority moderation review. Billing is processed by Paddle, our payment provider -- SpatialProbe never sees or stores your card details directly. You can change plans, update payment details, or cancel any time from Account settings ("Manage subscription"), which hands off to Paddle's own billing portal. Cancelling stops future billing.

Free trial. Every plan starts with a 7-day free trial. A payment method is required to start the trial, but you are not charged during it. If you cancel before the trial ends, you won't be billed at all. If you don't cancel, the trial converts automatically into a paid subscription at the price shown on the pricing page at the moment the trial ends, and billing continues monthly from there until you cancel.

Refunds. New subscribers get a 14-day money-back guarantee on their first payment on a plan (i.e. the charge that converts your trial to paid) -- if it's not for you, contact support within 14 days of that first charge for a full refund, no questions asked. Beyond that window, and for every renewal payment after the first, payments are non-refundable except where your local consumer-protection law requires otherwise (e.g. EU/UK buyers have a statutory 14-day withdrawal right on digital services, which this 14-day guarantee is intended to match or exceed -- it doesn't reduce whatever stronger right your own local law already gives you). Cancelling stops future billing but doesn't itself trigger a refund of the period already paid for -- you keep access until that period ends.

6. Your privacy

SpatialProbe doesn't run ads or trackers, and doesn't sell your data to anyone. The full details -- exactly what's collected, who it's shared with (Paddle for billing, Google Workspace for transactional email, Cloudflare for bot protection -- never anyone else), how long it's kept, and your rights under GDPR/equivalent local law -- are in the standalone Privacy Policy.

7. Deleting your account

You can permanently delete your account at any time from Account settings -- no need to contact support first. When you do:

  1. Everything private is deleted outright: drafts, favorites, your profile bio/avatar/saved starting location, and any photo/journey/comment/collection that never actually went public (still pending review, rejected, or kept private).
  2. Public content licensed under CC BY 4.0 or CC BY-NC 4.0 stays up, exactly as described in Section 3 -- the irrevocable license you granted on it doesn't expire just because the account that granted it is gone. It stays credited to your username, which is retained (not released for reuse by a new account) specifically so that credit keeps meaning something.
  3. Public content licensed under "All rights reserved" is, by contrast, deleted outright, along with everything private above -- see Section 3's own explanation of why that option specifically gives you this guarantee. Nothing survives anywhere SpatialProbe granted it to, because nothing was.
  4. If deleting a photo/video this way leaves a still-live Journey with a gap in it, that Journey is automatically reverted to draft with the missing item(s) flagged -- see Section 3's own note on this. A Journey itself, if published and clear of any moderation flag, survives your account's deletion the same way CC-licensed photos do (it's your public work, same reasoning), just possibly needing your attention -- or whoever you'd shared editing access with, if that ever becomes a feature -- before it reads cleanly again. Currently only the account owner can fix a flagged gap, so a published Journey by a deleted account with unresolved gaps stays in draft indefinitely.
  5. Any active subscription is cancelled immediately as part of the same request -- you won't be billed again. Billing records themselves (what you were subscribed to, the fact of past payments) are kept as required for accounting/tax purposes and to handle any refund or dispute, same as any business has to retain financial records.
  6. Sign-in is disabled immediately -- deletion cannot be undone from your side.

If you'd rather your already-public CC-licensed content came down too, contact support directly and we'll look at it on a case-by-case basis (this isn't automatic, for the reasons in Section 3 -- content already used/downloaded elsewhere under a CC license can't be un-licensed retroactively either way). This doesn't apply to "All rights reserved" content, which is already removed outright as part of account deletion itself, with nothing further to request.

8. Disclaimers & limitation of liability

The Service is provided on an "as is" and "as available" basis. While we make reasonable efforts to maintain availability and safeguard your content, SpatialProbe does not guarantee uninterrupted access, error-free operation, or that content will never be lost. You are responsible for maintaining independent backups of any irreplaceable files.

To the maximum extent permitted by applicable law:

  1. SpatialProbe shall not be liable for any indirect, incidental, consequential, special, or punitive losses (including lost profits, lost data, or business interruption) arising out of or related to your use of the Service; and
  2. SpatialProbe's total aggregate liability for all claims arising under or relating to these Terms or the Service shall be capped at the total amount paid by you to SpatialProbe in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded under the laws of England and Wales (including statutory rights under the UK Consumer Rights Act 2015).

9. Governing law & disputes

These Terms are governed by the laws of England and Wales, and any dispute not resolved informally (contact us first -- see Section 11) is subject to the exclusive jurisdiction of the courts of England and Wales. If you're a consumer resident elsewhere, this doesn't take away any mandatory protection your own local law gives you that can't be contracted out of.

10. Changes to these Terms

We may update these Terms as the Service changes. Meaningful changes will be reflected here with an updated date at the top of the page; continuing to use the Service after a change means you accept the updated Terms.

11. Takedown requests, copyright & questions

If you believe content hosted on SpatialProbe infringes your copyright or trademark, or otherwise violates these Terms, please contact our designated Copyright Agent with the following details:

  1. Identification of the copyrighted work or legal right being infringed;
  2. The exact URL or location on SpatialProbe of the allegedly infringing material; and
  3. Your contact information and a brief statement that you hold the rights or are authorized to act on behalf of the owner.

We respond promptly to clear notices of alleged infringement and will disable access to or remove infringing material. Repeat infringers will have their accounts terminated.

12. General provisions

If any part of these Terms is found to be unenforceable, the remaining sections will stay in full effect. We may assign our rights and obligations under these Terms (such as in the event of a merger, acquisition, or sale of assets), but your rights under these Terms will not be affected. These Terms, together with our Privacy Policy, make up the entire agreement between you and SpatialProbe regarding your use of the Service.
